a)Unless otherwise inconsistent with the context the word “person” shall include corporation; “goods’ shall include services;
b)“Groove Tiles & Stone” shall mean its successors and assigns.
c) “Customer” shall mean the person named on the invoice or sales order in the case of cashcustomers and the person named as “Applicant” on the credit application in the case of account customers.
2.Offer and Acceptance
a)Any quotation made by Groove Tiles & Stone is not an offer to sell or to provide goods.Groove Tiles & Stone shall not be bound by any order given in pursuance of any quotation until it is accepted in writing.All orders are subject to acceptance by Groove Tiles & Stone within thirty (30) days of receipt by Groove Tiles & Stone of the order.
3.Delivery
a)Any date quoted for delivery (“the quoted date”) is an estimate only and unless a guarantee shall be given by Groove Tiles & Stone in writing providing for liquidated damages for failure to deliver by the quoted date Groove Tiles & Stone shall not be liable to the customer for any loss or damage howsoever arising even if arising out of negligence of Groove Tiles & Stone failure to deliver on or before the quoted date.
b)It is the responsibility of the customer to check all goods on arrival.No claims will be accepted in relation to incorrect or faulty product after the goods have been layed.
4.Payment
a)Cash Customers – unless otherwise agreed in writing, payment for the goods must be either prior to delivery or pick up or COD.
b)Account Customers – unless otherwise agreed in writing, payment terms are cash thirty (30) days from the end of the month in which the goods are invoiced to the customer.An account keeping fee of 1.5% or such amount as otherwise notified in writing by the company to the customer from time to time, may be charged on all accounts which are unpaid 30 days after the end of the month in which the goods are purchased.
c)The customer shall pay the price of any goods supplied by Groove Tiles & Stone and any GST in addition to the price.
5.Title
a)Notwithstanding the delivery of goods or part thereof, the goods remain the sole and absolute property of Groove Tiles & Stone as full legal and equitable owner until such time as the customer shall have paid Groove Tiles & Stone.
6.Claims and Returns
a)Credits will not be issued upon the expiration of 2 months from the date of purchase or if shade or batch is no longer available, goods which have been especially ordered, or goods that are not returned in full boxes.
b)All goods returned are subject to a minimum of 20% handling fee.
7.Natural Stone Product
a)Due to the fact that marble and granite are natural products, reasonable variations in colour and veining must be expected and Groove Tiles & Stone shall not be liable for any such variations as may occur in materials supplied.
b)We recommend that Natural Stone Products should only be laid by experienced licensed stone fixers.Inexperience with these materials can result in damage to the product or inferior finish.Groove Tiles & Stone shall not be liable for any damage or breakage whatsoever occurring after delivery or for any loss incurred by the customer or fixers as a result of such damage or breakage.
c)Due to the different composition of natural stones and tiling surface areas it is recommended that you seek advise on the application process from a tile adhesive manufacturer.
